Which Electrical Code Does Florida Enforce?
Florida currently enforces the 8th Edition (2023) Florida Building Code, Electrical, which became effective December 31, 2023 and has been enforced statewide since January 1, 2024. That edition is based on the 2020 National Electrical Code — not the 2023 or 2026 cycle you may see referenced for other states. The Florida Building Commission adopts and amends the code at the state level, but your county or city building department is still the inspecting jurisdiction that issues the permit, and some jurisdictions layer their own local amendments on top of the state code.

Permit and Licensing Requirements in Florida

Counties like Miami-Dade publish their own lists of permit-exempt minor work, but a dedicated new circuit for an EV charger does not appear on those lists — it requires a permit.
Can You Install Your Own EV Charger Circuit?
Florida Statute 489.503(6) lets an owner of a single-family or duplex residence act as their own electrical contractor for construction, maintenance, repair, alteration of, and addition to that home — provided it's for the owner's own use and occupancy and not intended for sale. That's a real permit exemption, not just a license exemption — but it comes with real strings attached: the owner has to personally appear and sign the building permit application, has to satisfy the local permitting agency's requirements showing they understand their obligations under the law, and can't hire an unlicensed person to do the work in their place. Sell or lease more than one home you wired yourself within a year of finishing it, and the statute treats that as prima facie evidence the exemption was used to avoid licensing rather than to work on your own home.
Doing the work yourself still means passing the same inspection. The exemption covers who's allowed to pull the permit and do the labor — it doesn't change what the inspector is checking. A DIY circuit still has to meet the same NEC 625 and Article 220 requirements a licensed electrician's work would, and a failed rough-in or final inspection costs more time than hiring it out in the first place for most homeowners.
Utility Programs That Are Actually Live in Florida
Florida doesn't run a statewide EV charger rebate program the way some states do. What's real is utility-specific, and it runs on two different models — a subscription and a bill credit — that are easy to conflate with a one-time rebate. Here's what I could confirm on the utilities' own pages and press materials as of August 2026:
- FPL EVolution Home isn't a rebate at all — it's a subscription. FPL installs and maintains a Level 2 charger for a flat monthly fee: $27/month for equipment-only if you already have a 240V circuit in place, or $36/month for full installation (FPL handles the permitting), plus per-kWh usage charges with a lower off-peak rate. If you want to own the charger outright rather than pay a recurring fee, this program isn't the right fit — it's worth comparing the total 3-5 year cost against a one-time installation before enrolling.
- Duke Energy Florida runs two residential programs launched in March 2025:
- A Charger Prep Credit that's project-based with no fixed published cap — it goes toward make-ready electrical work (new outlets, wiring improvements, panel upgrades) needed to support a Level 2 or higher charger, but it excludes the charger hardware and software itself, plus permit fees.
- An Off-Peak Charging Credit worth $7.50/month on your bill for Level 2 charging during designated off-peak windows (10 a.m.–6 p.m. and 11 p.m.–5 a.m. weekdays, or anytime weekends and holidays), with no enrollment cap.
None of these change the electrical answer — whether your panel needs an upgrade is still a load calculation, not an incentive question. Condos, HOAs, and Renters: Florida's Right-to-Charge Law Is Narrower Than It Sounds
Florida does have a right-to-charge statute — but it's scoped to condominiums, not every homeowner or renter in the state:
- Condo owners (FS 718.113(8)). A declaration of condominium or restrictive covenant cannot prohibit a unit owner from installing an EV charging station within their limited common element or an exclusively designated parking area. The unit owner is responsible for the costs of installation, operation, maintenance, and repair, and the association can require a certificate of insurance naming it as an additional insured, due within 14 days after the association approves the installation.
- HOA-governed homes (Chapter 720). There is no equivalent provision. Chapter 720, Florida's Homeowners' Association Act, does not grant individual owners a statutory right to install a charging station the way Chapter 718 does for condos — an HOA can still approve or deny a request under its own recorded covenants and architectural review process.
- Renters. Florida has no dedicated statewide right-to-charge statute for tenants. Whether a landlord allows a charger installation, and who pays for it, is governed by the lease and the landlord's discretion rather than a state law.

Florida's Public Charging Buildout — and a Funding Fight Worth Knowing About
Florida already has a substantial public charging network — 452 fast-charging stations and roughly 1,708 Level 2 chargers open to the public as of early 2025 — and the Federal Highway Administration reviewed the state's highway corridor buildout and approved it as sufficiently built out. That status is now driving a real policy fight: the Florida Department of Transportation is proposing to redirect $197 million of its remaining federal NEVI (National Electric Vehicle Infrastructure) funding away from traditional EV chargers and toward a "Florida Aerial Highway Network" — 32 charging and landing pads for electric air-taxi aircraft, at an estimated $5.6 million per site — a proposal that drew public criticism from clean-energy and EV-charging advocacy groups as of late July 2026.
None of that changes the home-panel question, but it's a reminder that public fast-charging growth in Florida isn't guaranteed to keep pace with EV adoption the way it has in states still actively expanding their NEVI-funded corridor — which is one more reason a reliable home charger, sized correctly for your actual panel, matters more here than in a state leaning harder on public infrastructure.
Does Your Florida Home Need a Panel Upgrade?
This is the question every Florida-specific factor above eventually funnels into, and the answer doesn't change based on your ZIP code, your utility, or which Florida city you're in: whether your panel needs an upgrade is decided by checking the NEC 220.83(A) load calculation for an existing home adding a charger against NEC 230.79's service-rating test — not by the amp number stamped on your panel door, its age, or a contractor's guess from across the garage.
Four things usually decide the outcome, in roughly descending order of impact:
- Central air conditioning. Almost every Florida home runs central AC as its dominant fixed load, and in a hot, humid climate that load tends to run larger than in milder states — it's usually the single biggest factor eating into a panel's available headroom.
- Electric water heater and range. Florida homes split fairly evenly between gas and electric for these appliances; electric versions of either add meaningfully to the calculation, while gas removes them from it entirely.
- Charger amperage. A 16A or 24A charger setting asks for far less than a 48A charger. Dialing the charger down is one of the most direct ways to make a tight panel work without any electrical changes.
- The demand-factor math itself. NEC 220.83(A) counts the first 8 kVA of load at 100 percent and the remainder at only 40 percent — which is why many panels have more real headroom than adding up individual breaker ratings would suggest.

Once the Charger Fits: Breaker Sizing
Separate from the panel-capacity question, once you know what charger amperage your calculation supports, NEC 625.41 sets the minimum breaker at 125 percent of the charger's continuous load (EV charging is treated as a continuous load under NEC 625.42). What It Typically Costs in Florida
