1. Agreement to Terms
By accessing or using ChargeRight (evchargeright.com), you agree to be bound by these Terms of Service. If you do not agree, do not use the service. When you check the “I agree” checkbox at checkout and complete a purchase, you are explicitly confirming your acceptance of these terms.
2. What ChargeRight Is — and Is Not
ChargeRight provides informational electrical panel assessments based on the NEC 220.82 Optional Method. The service applies a published mathematical formula to data you provide and generates an estimate of your electrical panel's capacity to support an EV charger.
ChargeRight is NOT:
- A licensed electrical inspection or engineering service
- A substitute for evaluation by a licensed electrician
- A permit application or building code certification
- A professional opinion or recommendation to perform electrical work
- A guarantee that your panel is safe or code-compliant
- An instruction or encouragement for any person to perform electrical work
The AI-powered panel photo analysis uses computer vision technology (Google Gemini) to detect visible features in your uploaded photo. It is pattern matching, not a professional inspection. It can and will produce errors. All AI findings must be verified by a licensed electrician on-site.
3. Use of Service
By using ChargeRight, you agree to:
- Provide accurate and truthful inputs for your assessment
- Understand the report is not a permit, inspection, or engineering certification
- Confirm all findings and final installation decisions with a licensed electrician
- Not perform any electrical work yourself based on this report
- Not use the service for commercial resale, redistribution, or sublicensing
- Not reverse-engineer, scrape, or programmatically access the service
You must be at least 18 years old and have the legal capacity to enter into this agreement to use ChargeRight.
4. Payments and Refund Policy
The paid assessment is a one-time purchase of $12.99 (or the price displayed at checkout if a promotional discount applies). Payments are processed securely by Stripe. ChargeRight does not store your credit card information.
Because the assessment report is a digital product delivered instantly upon payment, all sales are final once the report has been generated and delivered. If you experience a technical issue that prevents report delivery, contact [email protected] and we will resolve the issue or issue a refund at our discretion. Refund requests for delivered reports will be considered on a case-by-case basis.
5. Intellectual Property
All content, reports, algorithms, software, and design elements of ChargeRight are the property of ChargeRight and its owner. When you purchase an assessment, you receive a personal, non-exclusive, non-transferable license to use your report for your own residential planning purposes. You may share the report with electricians, contractors, or other professionals you hire. You may not resell, redistribute, or commercially exploit the report or any part of the service.
6. Assumption of Risk
You acknowledge and agree that:
- Electrical systems are inherently dangerous. Improper installation or modification of electrical panels, circuits, or wiring can result in fire, electrocution, property damage, serious injury, or death.
- ChargeRight reports are based on data you provide and AI analysis of photos you upload. Incorrect inputs produce incorrect outputs. The AI can misidentify panel components.
- You assume all risk for any decisions you make based on information provided by ChargeRight.
- A licensed electrician must verify all findings on-site and perform all electrical work. You agree to hire a licensed professional before acting on any information in your report.
7. Limitation of Liability
To the maximum extent permitted by applicable law, ChargeRight's total liability to you for any claims arising from or related to your use of the service is limited to the amount you paid for the assessment (maximum $12.99).
In no event shall ChargeRight, its owner, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, property damage, personal injury, or damages arising from electrical work, whether or not ChargeRight has been advised of the possibility of such damages.
8. Indemnification
You agree to indemnify, defend, and hold harmless ChargeRight, its owner (Jason Walls), and its affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the service or reliance on any report or information provided
- Any electrical work performed in connection with the assessment
- Your violation of these terms
- Any claim by a third party related to your use of ChargeRight
9. Dispute Resolution
If a dispute arises, you agree to first attempt to resolve it informally by contacting [email protected]. If the dispute cannot be resolved within 30 days, either party may initiate binding arbitration under the rules of the American Arbitration Association, to be conducted in Clark County, Indiana.
You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration against ChargeRight. Either party may bring claims in small claims court as an alternative to arbitration.
10. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Indiana, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought in the courts of Clark County, Indiana.
11. Third-Party Services
ChargeRight uses the following third-party services to operate. By using ChargeRight, you acknowledge that your data may be processed by these providers in accordance with their respective terms and privacy policies:
- Stripe — payment processing
- Google Cloud / Gemini — AI-powered panel photo analysis
- Firebase / Firestore — data storage and authentication
- Vercel — web hosting and deployment
ChargeRight is not responsible for the practices or policies of these third-party services.
12. Changes to Terms
We may update these Terms of Service from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where practical, notify you via email or a notice on the site. Your continued use of ChargeRight after changes are posted constitutes your acceptance of the revised terms.
13. Disclaimer of Warranties
Some jurisdictions do not allow the exclusion of certain warranties. In such cases, the above exclusions apply to the maximum extent permitted by applicable law.
14. AI and Calculation Accuracy
You acknowledge and understand that:
- The AI-powered panel photo analysis may misidentify panel components, breaker types, amperage ratings, circuit labels, or safety hazards. It is assistive technology, not a professional inspection.
- NEC 220.82 calculations are mathematical estimates based entirely on user-provided inputs. If you enter incorrect data, the calculations will produce incorrect results.
- The absence of a safety warning in your report does not mean the absence of a safety hazard. Only an on-site evaluation by a licensed electrician can confirm actual conditions.
- No output from ChargeRight — including load calculations, capacity estimates, upgrade recommendations, cost estimates, or charger compatibility assessments — should be treated as a professional inspection, safety certification, or guarantee of electrical safety.
15. No Professional Advice
Nothing in this service constitutes professional electrical advice, engineering services, safety certification, legal advice, or tax advice. ChargeRight is an informational planning tool designed to help you have a more informed conversation with a licensed electrician. It is not a substitute for hiring one.
Always consult qualified, licensed professionals before making decisions about electrical work, panel modifications, charger installation, permit applications, tax credits, or any matter involving the safety of your home or property.
16. User Content and Photo License
By uploading photos to ChargeRight, you grant us a non-exclusive, royalty-free, limited license to process, analyze, store, and transmit your photos solely for the purpose of providing the assessment service. This includes sending your photos to Google Cloud (Gemini) for AI analysis.
You represent and warrant that you have the right to upload the photos you submit (for example, they are of your own property or you have the property owner's permission) and that the photos do not violate any third party's rights.
17. Third-Party Reliance
Assessment reports are prepared solely for the individual who purchased the assessment. Third parties — including electricians, contractors, inspectors, real estate agents, home buyers, or any other person — who view, act on, or rely upon this report do so entirely at their own risk. ChargeRight assumes no duty or liability to any party other than the original purchaser, and even then, only as limited by these Terms.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
19. Entire Agreement and Waiver
These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and ChargeRight regarding your use of the service and supersede all prior agreements, understandings, and communications, whether written or oral.
The failure of ChargeRight to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision shall be effective only if in writing and signed by ChargeRight.
20. Termination
ChargeRight may suspend or terminate your access to the service at any time, with or without cause, including for violation of these Terms. You may stop using the service at any time.
Upon termination, the following sections shall survive and remain in effect: Intellectual Property (Section 5), Assumption of Risk (Section 6), Limitation of Liability (Section 7), Indemnification (Section 8), Dispute Resolution (Section 9), Governing Law (Section 10), Disclaimer of Warranties (Section 13), AI and Calculation Accuracy (Section 14), No Professional Advice (Section 15), Third-Party Reliance (Section 17), and Severability (Section 18).
21. Electronic Communications
By using ChargeRight or providing your email address, you consent to receive electronic communications from us, including assessment reports, service notifications, and support correspondence. You agree that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
